Man Who Gary Collins Hit in DUI Crash Dies

TMZ has learned that the elderly man who was hit by a car driven by a drunk Gary Collins has died.

Collins was arrested after plowing into a car driven by 89-year-old Warren Gates in October. Gates had been hospitalized since the accident, and sadly died 8:00 PM Friday.

Collins pleaded no contest last Thursday to DUI charges and was sentenced to 96 hours in jail.

No word yet on whether Collins will be hit with additional charges. Collins was, however, found not to be at fault for causing the accident. Collins' lawyer tells TMZ, "We are saddened to hear that the gentleman has passed away. This was an unfortunate accident. We are pleased that the police found that Mr. Collins was not at fault. We send our condolences to the family."

94. I don't like celebrities who get away wih anything. But people read the story. Collins plead no lo to the DUI but he was not responsible for the accident. Put it this way. You go to a party and have 2 glasses of wine. On your way home someone hits you and they die. Yes you are drunk but not the cause of the accident. So should you go to jail for manslaughter?. 97. VERY SAD AND YES MR. COLLINS SHOUD NOT DRINK AND DRIVE OF COURSE. HOWEVER, I DO NOT THINK ANY POSTER I HAVE READ (SO FAR ANYWAY) HAS TUNED INTO THE FACT THAT IT WAS CLEARLY ESTABLISHED THAT THIS OLD MAN WAS MOST DEFINITELY AT FAULT IN THIS ACCIDENT. MY POINT BEING THAT ALTHOUGH I OBVIOUSLY AGREE THAT IF MR. COLLINS HAD BEEN FOUND TO HAVE CAUSED THE ACCIDENT, THEN YES, PROSECUTE FOR MANSLAUGHTER ALL THE WAY---BUT SINCE IT IS CLEAR THE DECEASED GENTLEMAN CAUSED THE ACCIDENT ACCORDING TO POLICE, THEN IT MAKES NO SENSE TO CHARGE MR. 100. It is very confusing to me. Vick received all kinds of racial remarks because of behavior towards dogs, but this man was DUI and resulted in the death of an innocent person and I am reading comments like "I like Collins but........!

101. I do not get these people. I love to go out every 5 or 6 months, hit the bars and party. I cab home. Have these celebs ever heard of them? I figure it is much cheaper then a ticket and better then killing someone!

102. What do they mean, not his fault. Anytime boose is involved that person IS GUILTY. Atleast for ordinary people. I forgot for political leaders and famous stars, they are immune from guilt. Hope they don't take out a child next time, and there will be a next time.

103. I'm sorry for Mr. Gates family but didn't the report say that Gary Collins was not in the wrong? So why all the hostility toward Mr. collins except for the drinking. Don't get me wrong I don't think anyone should drink and drive. But am I missing something here?

104. If he was not at fault for the accident then how can they charge him. I feel bad for the man that died. But i read it was not collins fault. He should have gone to jail for the DUI. But not the rest of it. If he was at fault then he should he in jail. This is 1 reason i do not drink.

105. I recently lost my husband of twenty years to a careless driver, so I do not condone drunk driving--and I don't drink and never have. However---DID YOU PEOPLE READ THE ARTICLE? It says the OLD MAN was a FAULT in the accident. This means, since Collins wasn't charged with culpability nor was he assigned a portion of responsbility for the accident, his being drunk or under the influence is, from a criminal standpoint, irrelevant.
Of course, morally, it is relevant, and I believe he belongs in jail for getting behind the wheel of a car, no accident or not. However, from a strict liability standpoint, he cannot be charged with involuntary, or vehicular since he was not the one even charged with the accident.
Now, what if it had been the other way around--Collins killed by a nearly 90 year old, no alcohol involved---would there be the hue and cry for stricter laws for elderly people who are not capable and shouldn't be on the road? Just a thought.
