Man Who Gary Collins Hit in DUI Crash Dies

TMZ has learned that the elderly man who was hit by a car driven by a drunk Gary Collins has died.

Collins was arrested after plowing into a car driven by 89-year-old Warren Gates in October. Gates had been hospitalized since the accident, and sadly died 8:00 PM Friday.

Collins pleaded no contest last Thursday to DUI charges and was sentenced to 96 hours in jail.

No word yet on whether Collins will be hit with additional charges. Collins was, however, found not to be at fault for causing the accident. Collins' lawyer tells TMZ, "We are saddened to hear that the gentleman has passed away. This was an unfortunate accident. We are pleased that the police found that Mr. Collins was not at fault. We send our condolences to the family."

47. This is a very sad story. My prayers are with all involved. People don't drink and drive!!!! Collins has made a mistake that can't be taken back. My heart breaks for families who lose a loved one to a drunk driver. This is a crime that can happen to ANYONE - Christmas parties are going on this month - be careful everyone that has a drink.

48. It's sad that Mr. Gates died in this accident, but just because Mr. Collins was drinking and driving doesn't necessarily mean he was at fault for the collision. If the Mr. Gates was found to be at fault for the crash, then Mr. Collins will only be charged with 23152(a) V.C. - Misd DUI and maybe 23152(b) V.C. - BAC .08% or Greater. This however DOES NOT excuse the fact Mr Collins was drinking and driving. Find a Designated Driver...bottom line, you should NEVER DRIVE DRUNK!!!!

49. Anyone else would get a lot more jail time. This man KILLED another human being. Just because he is rich and famous, shouldnt mean he is above the law. God bless that family.

50. How disappointing....how OLD must we get to understand if you're going to drink, just stay home! I've always kind of enjoyed him but in this case, he was drunk, the guy died and he should be charged with vehicular manslaughter......period.

55. Um, does anyone read the facts before passing judgment? The article clearly states: "Collins was, however, found not to be at fault for causing the accident."

Yeah, he was drunk and should be punished. But if he was not the actual and/or proximate cause of the accident, and therefore Mr. Gates' death, how is Collins a murderer?

If you all read the article it says that he was not responsible for causing the accident...he just happened to be drunk while being in a crash but his drunkeness did not cause the crash...I'm absolutely not saying that because of I approve of anyone driving drunk but just wanted to point out that he can't be charged with killing that guy because he wasn't the one that caused the accident. Obviously if he had caused the accident then by all means go after him full force for vehicle homicide.

58. If you are going to comment, get your facts straight first. Mr. Gates is the one who drove through the stop sign and plowed into Collins' car. NOT the other way around. No excuse for driving drunk, but the crash was not Collins' fault.
